This application must be used to register a Trademark/Service Mark. A document required or permitted to be filed under this Act cannot be filed unless it contains the minimum information required by the Act. Upon filing, the Certificate of Registration will be mailed to the applicant or his/her representative to the address provided on this Application. Since this application will be maintained on electronic format, it is important that the filing be legible. Documents with poor black and white contrast, or otherwise illegible, will be rejected. 3. This Application is to be used pursuant to Section 3(1) of Act 242, P.A. of 1969 for the purpose of registering a trademark or service mark. A trademark is any word, name, symbol, or device, or any combination thereof, other than a trade name in its entirety, adopted and used by a person to identify goods made or sold by him or her and to distinguish them from similar goods made or sold by others. Similarly, a service mark is a mark used by a person in the sale or advertising of services to identify his or her services and distinguish them from the similar services of others. The term person, as sued above, means an individual, firm, partnership, corporation, association, union, or other organization. A mark is not able to be registered until it has actually been adopted and used in Michigan. The registration is effective for ten years and is renewable for successive terms of 10 years upon the filing of an application for renewal, on a form provided by the Bureau, within six months prior to the expiration date. 4. The Department of Licensing and Regulatory Affairs, Bureau of Commercial Services is appointed as the applicant's agent for service of process in actions relating to the registration or application for registration if: (1) the applicant is or becomes a nonresident individual, partnership or association, (2) the applicant is or becomes a foreign corporation or limited liability company without a certificate of authority to transact business in Michigan, or (3) the applicant cannot be found in Michigan. 5.
