4 Form GATT Read these instructions before completing this form. Make sure all applicable spaces have been filled in before you return this form. BASIC INFORMATION FormGATT is for registration of a copyright claim in a work in which U.S. copyrightwasrestoredunderthe1994UruguayRoundAgreementsAct(URAA). Youcanusethisformtoregisterasingleworkoraseriesofworkspublishedunderasingletitleinmultipleepisodes,installments,orissuesduring the same calendar year. Theauthor(s)foreachworkintheseriesmustbethe same, and the owner(s) of U.S.copyrightforeachworkintheseriesmustbe thesame.However,theauthorandtheownerofU.S. copyright do not have to be the same. TobeeligibleforcopyrightrestorationundertheURAA,aworkmustmeet allthefollowingrequirements: 1 Theworkisnotinthepublicdomaininitssourcecountrythrough expiration of the term of protection. 2 TheworkisinthepublicdomainintheUnitedStatesbecauseof a noncompliance with U.S.copyrightformalities; b lackofsubjectmatterprotectioninthecaseofsoundrecordings fixedbeforeFebruary15,1972;or c lack of national eligibility. 3 Theworkhasatleastoneauthor(orrightholderinthecaseofsound recordings) who was, at the time the work was created, a national or domiciliaryofaneligiblecountry. 4 Ifpublished,theworkwasfirstpublishedinaneligiblecountryandwas notpublishedintheUnitedStatesduringthe30-dayperiodfollowing publicationintheeligiblecountry. Note:RestorationofU.S.copyrightforarchitecturalworksisavailableonlytoarchitecturalworkspublishedorconstructedonorafter December1,1990. Unpublished sound recordings: Send one phonorecord that best represents the copyrightable content of the work in which U.S. rights are restored and for which registration is being made. Deposit Restoration of Copyright Note: A descriptive statement of a machine-readable work is a separate written statementspecifyingthetitleandthenatureofthework(computerprogram, database,orvideogame,forexample)andincludingabriefdescriptionofthe purposeorsubjectmatterofthework. Exceptions: Previously registered works: no deposit is needed for works registeredpreviouslyintheU.S.CopyrightOffice.Three-dimensional works of the visual arts: deposit one or more photographs, preferably in color. Machine-readable works: (a) deposit one machine-readable copy of the work plusadescriptivestatement(seenotebelow),or(b)depositrepresentational excerptsofthework,suchasprintouts,or,iftheworkisanaudiovisualwork, a videotape. Published works: Send one copy that best represents the copyrightable content of each work in which U.S. rights are restored and for which registration is being made, in the following order of preference: 1 Theworkasfirstpublished; 2 Areprintorrereleaseoftheworkasfirstpublished; 3 Aphotocopyoridenticalreproductionoftheworkasfirstpublished; 4 Arevisedversioncontainingasubstantialamountofthecopyrightable contentoftherestoredworkasfirstpublished,together with a written statement of the percentage of the restored work appearing in the revised version. Source country:Foranunpublishedwork,thesourcecountryistheeligible countryofwhichtheauthorisanationalordomiciliary.Ifarestoredworkhas morethanoneauthor,thesourcecountryisthecountryofwhichthemajority offoreignauthorsarenationalsordomiciliaries.Ifthemajorityofauthors arenotforeign,thesourcecountryisthenationotherthantheUnitedStates thathasthemostsignificantcontactswiththework. Forapublishedwork,thesourcecountryistheeligiblecountryinwhichthe workwasfirstpublished.Iftherestoredworkwaspublishedsimultaneously intwoormoreeligiblecountries,thesourcecountryistheeligiblecountry thathasthemostsignificantcontactswiththework. Owner of U.S. copyright: A claim in a restored work can be registered only in the name of the owner(s) of the U.S. copyright, that is, in the name of the owner(s) of all U.S. rights in that work. A licensee or other owner of only certainexclusiverightsinaworkisnotpermittedtoregisteraclaimina restored work in his or her name. Eligible country: A nation other than the United States that is a member of theBerneConvention,amemberoftheWorldTradeOrganization,orsubject to a presidential proclamation restoring the U.S. copyright to works of that nation on the basis of reciprocal treatment. Definitions CopyrightOfficefeesaresubjecttochange.Forcurrentfees,checktheCopyrightOfficewebsiteatwww.copyright.gov,writetheCopyrightOffice,orcall (202) 707-3000 or 1-877-476-0778 (toll free). Feescanbepaidbycheck,moneyorder,orbankdraftpayabletotheRegister of Copyrights. All non-U.S.checks,moneyorders,andbankdraftsmust beredeemablewithoutaserviceorexchangefeethroughaU.S.institution, payable in U.S. dollars, and imprinted with American Banking Association routingnumbers.Postalmoneyordersandinternationalmoneyordersthat arenegotiableonlyatapostofficearenotacceptable. TheCopyrightOfficealsoacceptsAmericanExpress,Visa,andMasterCard forfilingsundertheURAA. Debit cards are not accepted. Tochargeafilingfeeonacreditcard,includeinaseparateletterthetype ofcard,thenameoftheindividualorfirmasitappearsonthecard,theaccountnumber,theexpirationdate,thetotalamountdue,andthesignatureof thecardholderauthorizingtheOfficetochargethefeetotheaccount.Donot give credit card information anywhere on the application form itself.
