* Plaintiff v. * * * Defendant * * * IN THE CIRCUIT COURT FOR ________________________ Civil No.: * * * * * * * * * * * ADDENDUM TO ORDER FOR CUSTODY INVESTIGATION and NOTICE OF TERMS OF DISCLOSURE For use when an investigator, other than the local department of social services (DSS), requires access to DSS records in order to adequately complete a custody investigation. BY ORDER OF THIS COURT dated ,2 , (investigator) has been ordered to conduct a custody investigation in the above-captioned case and will need access to the records of the Department of Social Services (DSS). It is therefore this hereby ORDERED, that DSS shall provide to the investigator copies of all records regarding the parties and their minor children, including Child Protective Services' records; and it is further ORDERED, that the records of DSS, and all information derived from those records, that have been incorporated into the investigator's report to the Court, may be disclosed only to: (1) the parties and their attorneys; (2) the agents and employees of the parties' attorneys; (3) independent experts retained by the parties or the Court in connection with the custody and visitation issues in this action; and it is further ORDERED, that before the records are disclosed, the individual to whom the records are disclosed shall be provided a copy of the attached Notice of the Terms of Disclosure and shall agree to abide thereto. NOTICE OF TERMS OF DISCLOSURE Records of the Department of Social Services are being provided to you in accordance with the attached Order for Custody Investigation and Addendum. You are bound by the terms of that Order and Addendum and are precluded from further disclosing information or documents received pursuant to that Order and Addendum to anyone other than the persons specified therein. Failure to abide by the terms of that Order and Addendum may subject you to contempt, or other sanction by the Court. The unauthorized release of the said documents or information contained in the documents subjects you to the penalties set forth in Maryland Annotated Code, Article 88A, Section 6(e). Any personally identifiable information pertaining to the reporter(s) of abuse or neglect or any person whose life or safety may be endangered by disclosure shall be redacted prior to submission by the Department of Social Services to the investigator, and shall not be disclosed absent either consent of the reporter(s) of abuse or neglect or person(s) whose life or safety may be endangered for further Order of this Court. In order that documents released pursuant to the attached Order and Addendum do not disclose personally identifiable information with respect to any child, his or her natural or adoptive parents and/or reporter(s) of abuse or neglect and person(s) whose life or safety may be endangered by disclosure, any such documents which shall be filed as exhibits in this Court shall be redacted to exclude personally identifiable information so as to protect the confidentiality of such persons or shall be submitted under seal. Within 30 days after final disposition of this action, all documents and copies thereof, subject to the attached Order and Addendum which have not been introduced as exhibits or otherwise offered or put into the record of this civil action shall be returned to the Department of Social Services.
