In The Circuit Court For The Seventh Judicial Circuit of Illinois Sangamon County, Springfield, Illinois IN RE THE MARRIAGE OF (Petitioner) VS. } Case Number: (Defendant) AFFIDAVIT OF SEPARATION AND WAIVER OF TWO YEAR PERIOD Each of the undersigned states: 1. The parties have lived separate and apart from each other for a continuous period in excess of six (6) months before the date of this Affidavit. 2. Pursuant to 750 ILCS 5/401 of the Illinois Marriage and Dissolution of Marriage Act, the parties waive the requirement of living separate and apart for a continuous period in excess of two (2) years to obtain a Dissolution of Marriage on the grounds that irreconcilable differences have led to the irretrievable breakdown of their marriage. Under penalties as provided by law pursuant to 5/1-109 of the Code of Civil Procedure, each of the undersigned certifies that the statements set forth in this Affidavit and Waiver are true and correct.
