For Stepparent Adoptions filed where the parental rights are to be terminated based on the failure to make contact for more than one year and the failure to provide support for the child/children when able to do so, under the provisions of Civil Code, you are reminded that the Decree of Adoption must contain a Termination Statement with regard to the Natural Parent and that the Proof of Service with original citation or Proof of Publication with Original Citation must be on file at least three days prior to the hearing date. All parties must be present at the hearing unless specifically excused by the Judge of the Superior Court. In the case of Adult Adoptions, Attorneys of Record may appear on behalf of their client providing they have "Power of Attorney" to act on their client's behalf. A Consent and Agreement form is not required for Adult Adoption actions. All documents submitted to the Court must be an original and three copies.
