INDEMNITY AGREEMENT In the event arrangements are made whereby herein called ''Company'' furnishes equipment or personnel to or for the benefit of the undersigned, herein called the ''Undersigned,'' to be employed in behalf of the Undersigned or at its request on behalf of any third person, this Indemnity Agreement shall become part of such arrangements and is agreed as follows: All personnel furnished by Company shall be deemed the servants of the Undersigned and together with the equipment furnished by the Company shall be employed under the supervision of the Undersigned or its agents, and such equipment shall, unless rejected by the Undersigned for cause, be deemed acceptable for the intended use and shall be used at the risk of the Undersigned, who shall be responsible for any loss, damage or injury to person, including death resulting therefrom, or property occurring during its connection with such services, however such loss, damage or injury be occasional, and whether or not, occasioned by unacceptability or any such equipment or negligence of Company, its officers, agents and employees (who are hereafter included in the term Company), and the Undersigned agrees to indemnity and hold harmless Company from any such loss, damage or injury or claims arising or asserted on account thereof, and should suit or action be brought against Company on account thereof, then upon notice, the Undersigned will undertake the defense of such suit or action at its own cost and expense and will pay any judgment against Company entered therein. Nothing herein shall be deemed to relieve the Undersigned of any liability to Company which it would have but for this Agreement.
