Added Indian Child Welfare Act (ICWA) language and references. This form is intended to be used in both ch. 48 and ch. 938 matters. This form may not be used to extend a permanency plan hearing. The "order" section contains two mutually exclusive alternatives. 1a is to extend the current dispositional order for a period of up to 30 days. This is normally used when the request for an extension of a dispositional order is filed too close to its termination date such that a hearing cannot be timely held. The court can unilaterally extend the dispositional order for up to 30 days in order to allow the hearing to be held. 1b is used in any of the specific circumstances to extend the dispositional order for that period of time during which the delay exists, plus an additional 30 days to schedule the hearing. For example, if a juvenile absconds during the time a dispositional order is in effect and a request is made for an extension, the extension can be granted for so long as the juvenile is unavailable. Once the juvenile becomes available, an additional 30 days is granted to hold a hearing. The request has been made to extend the dispositional order. 2. The dispositional order has not expired or been terminated. 3. The court is unable to conduct a hearing on the request prior to the expiration or termination of present order. 4. This extension will not result in delay of required out of home placement findings. THE COURT ORDERS: 1. The present order in this case is extended until: (a period of not more than 30 days). a. (date) OR b. the period of delay resulting from the following circumstance(s) has elapsed, plus an additional 30 days.
