DECREE AND ORDER OF ACCEPTANCE OF RESIGNATION OF GUARDIAN FOR AN INCAPACITATED PERSON REMOVAL OF GUARDIAN FOR AN INCAPACITATED PERSON TERMINATION OF GUARDIANSHIP In the Interests of: First Name Middle Name Docket No. Commonwealth of Massachusetts The Trial Court Probate and Family Court Division Last Name Incapacitated Person/Respondent On the Petition for Acceptance of Resignation of First Name M.I. Last Name as Guardian. as Guardian. First Name M.I. Last Name Removal of Termination of the above-captioned Guardianship. The Court finds that: The Acceptance of Resignation of the above-named Guardian(s) (hereafter refered to as "Guardian"); OR Removal of the above-named Guardian(s) (hereafter refered to as "Guardian"); OR Termination of Guardianship is appropriate and it is in the best interest of the Incapacitated Person that: The Guardian's resignation be accepted; OR The Guardian be removed; OR The Guardianship be terminated. Notice has been properly given or waived and the same procedures to safeguard the rights of the Incapacitated Person that apply to a petition for appointment of a Guardian have been followed. A successor Guardian is appointed. (See Separate Decree of Appointment). The remaining Co-Guardian(s) shall continue to serve. The Court orders that: The Guardian be removed because: The Guardian is incapacitated or disabled. The Guardian is being investigated or has charges pending for assault and battery on and/or neglect of the Incapacitated Person.
