INSTRUCTIONS FOR TERMINATING GUARDIANSHIP OF THE PERSON OF A MINOR 1) Fill out the Petition as completely as possible and sign it before a notary. There is no filing fee. You do not need to know the case number to file the petition. 2) Ask the other adults involved (parents or guardians) to fill out Consent forms and sign before a notary. One Consent form is provided with this packet. You can make copies of that form if you need them. The person who signs the petition does not also need to sign a Consent form. 3) File the Petition and Consent(s) with the Probate Office. Deliver or mail to: Probate - Room 1005 Dane County Courthouse 215 South Hamilton Street Madison WI 53703 You may file the Petition even if you do not have Consents from all of the parties involved. If we don't have consents from everyone, we will probably have to schedule a hearing before terminating the guardianship. 4) The Court will review the file within a week and will either sign an order based upon the information in the Petition and Consents or appoint a Guardian ad Litem (G.A.L.) -- an attorney to represent the child's best interest. The Court will ask the G.A.L. to report by a certain date or will set up a hearing date before a court commissioner. You will be notified if a hearing is scheduled.
