FORM SUMMARY Name of Form: Waiver of Immediate Notice (Parental Consent/Abortion Waivers) JC-1622 §48.273(4)(b), Wisconsin Statutes JV 15 The law requires that a pregnant juvenile who has either filed a petition, or for whom a petition has been filed by a clergyperson, is required to receive immediate notice of all court proceedings. However, she can waive her right to immediate notice. In this case, she would receive 24 hours notice of future hearings. As far as the court is concerned, because of the stringent time requirements in holding hearings and issuing decisions, immediate notice is preferable to a waiver of immediate notice. If a juvenile waives immediate notice, and thus becomes entitled to 24 hours notice, there is no corresponding increase in the time allowed the court to either hold the hearings or issue a decision. Form Number: Statutory Reference: Benchbook Reference: Purpose of Form: Who Completes it: Distribution of Form: The pregnant juvenile completes the form. The original is filed with the Clerk of Circuit Court. Copies would be provided to the juvenile and, if a clergyperson filed the petition, to the clergyperson. This form would most likely accompany the "Petition to Waive Parental Consent for an Abortion," (JC-1620), although it could theoretically be filed later. Modification, last update 7/96.
