C. §. 1017. Petitioner may qualify to file for a Discretionary Expungement. OR The Petition is GRANTED on the basis that Petitioner was charged with a misdemeanor(s) or violation(s) in Title 4, 7, 11, 16, or 23 and the case was terminated in Petitioner's favor. (10 Del. C. § 1017 (a)(1)). Petitioner was charged with a felony(ies) in Title 11 or 16 and the case was terminated in Petitioner's favor one year or more ago (10 Del. C. § 1017(a)(2)). IT IS FURTHER ORDERED, that copies of this Court's order be delivered to the Petitioner or Petitioner's Attorney, the Division of Youth Rehabilitative Services and the State Bureau of Identification The Family Court shall remove all records related to the expunged charges within 60 days of the date of this order and shall place them in the control of the Supervisor of SBI. An offense for which records have been expunged does not have to be disclosed as an arrest by the Petitioner for any reason.
