(Original Agreement is attached) An agreement for a modification to the Domestic Relations Order concerning a PERA Benefit Plan. (Modified Agreement is attached) The Court having reviewed and considered the Agreement and if applicable, any statements made during a hearing on (date), finds the following: 1. The Court has jurisdiction over both parties and the parties have consented to the entry of this Order. 2. The Courts finds the Agreement, attached and incorporated into the Order, has been signed by both parties and entered into by them pursuant to §14-10-113(6), C.R.S. 3. The Court further finds that the parties have entered into this Agreement voluntarily and knowingly, and that the Agreement is reasonable and not unconscionable. The Court therefore Orders: that the attached Agreement be approved and adopted and incorporated into the Decree and Permanent Orders entered by the Court in the parties Dissolution of Marriage, Legal Separation or Invalidity of Marriage. or that the Modified Agreement be approved and adopted and the prior Domestic Relation Order for a PERA Benefit Plan previously entered on (date) be modified accordingly.
