Description
Form 3902 - CONFIDENTIALITY AGREEMENT. This form is used in Solano County civil cases to formalize confidentiality protections for participants in an Alternative Dispute Resolution (ADR) process. Consistent with California mediation confidentiality statutes, the agreement provides that no written or oral communications made during ADR may be disclosed to the assigned judge or used in future proceedings without written consent of all participants, including the neutral. The form also prohibits subpoenaing the neutral or ADR materials and confirms that written settlement agreements may be enforceable under CCP § 664.6.
