Addendum for Continued Marketing of Property by Seller due to Contingencies This Addendum shall amend a certain Sales Agreement dated between SELLER and BUYER for the purchase of: PROPERTY ADDRESS 1. Sale Condition. The Sales Agreement is contingent upon Buyer obtaining an executed agreement to purchase Buyer's property known as: no later than BUYER'S PROPERTY HUBBARD CONTINGENCY DATE with all contingencies of such Agreement except closing satisfied. 2. Listing. Buyer agrees to list Buyer's property with a Realtor within 48 hours of signing this Agreement and to use diligent efforts to secure a sale of Buyer's Property and to keep Seller or Seller's Agent informed of such efforts. 3. Automatic Termination If Buyer has not received an executed agreement for the purchase of their Property with all contingencies of such Agreement (except closing) satisfied by the Hubbard Contingency Date, this Sale Agreement shall terminate. If Buyer has received an executed agreement for the purchase of their Property with all contingencies of such Agreement satisfied (except closing) by the Hubbard Contingency Date, Buyer shall notify Seller no later than the Hubbard Contingency Date by signing and delivering to Seller or Seller's Agent the Contingency Removal Notice certifying the satisfaction of the Hubbard Clause conditions. 4. Marketing Property By Seller. Buyer understands that Seller may continue to market Seller's Property for sale after this Agreement is signed. If Seller receives a bone fide offer acceptable to Seller on or before the Hubbard Contingency Date, Seller shall provide written notice of Seller's intent to accept such offer to purchase. Buyer shall have, until [Time] on the second calendar day after receipt by Buyer or Buyer's Agent of Seller's Notice, the right to elect to either waive this Hubbard Contingency or terminate the Sales Agreement. 5. Waiver. At any time up to the Hubbard Contingency Date, Buyer may waive this Hubbard Contingency. In order to Waive the Hubbard Contingency, Buyer must sign and deliver to Seller or Seller's Agent the Contingency Removal Notice with the appropriate section filled in. 6. Termination. If Buyer fails to notify Seller or Seller's Agent by the Hubbard Contingency Date that either: 1. the Hubbard Clause conditions have been satisfied under Section 3 or 2. that Buyer elects to waive the Hubbard Clause under Section 5, then this Agreement shall automatically terminate. In the event this Agreement is automatically terminated, all deposit monies paid by Buyer shall be returned to Buyer and neither party shall have any other rights under this Agreement. Time shall be of the essence for all dates or notices required in this Addendum.
