Description
42.150 Motor Vehicles; Definitions; Right-of-Way (Note: The statutory language has been purposely simplified, and refinements applicable to many individual situations have been necessarily omitted in a work of this length. If the court considers it necessary to charge the law in greater detail, it will be necessary to go to the text of the applicable statute.) Right-of-way is the right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed, and proximity as to give rise to danger or collision unless one gives way to the other. O.C.G.A. §40-1-1(52)
