18.020 Contract Damages; Attorney's Fees (Expenses of Litigation); Generally The expenses of litigation are not generally allowed as a part of the damages. But, if the defendant has acted in bad faith or has been stubbornly litigious or has caused the plaintiff unnecessary trouble and expense, you may allow them. You should determine from the evidence the attorney's fees (or other expense), if any, as will be allowed. O.C.G.A. §13-6-11
