Description

08.030 Bailments; Burden of Proof In all cases of bailment, after proof of loss by the bailor, the burden of proof is on the bailee to show proper diligence. Loss, as used in this rule of law, does not only mean the losing of the thing bailed, but also damage or injury to the bailor's property. O.C.G.A. §44-12-44 Hawkins v. Haynes, 71 Ga. 40 (1883) Electro-Medical Devices Inc. v. Urban Medical Services Inc., 140 Ga. App. 776 (1976)
