L1059 - DECLARATION OF LOST WRIT. This form is used in the Orange County Superior Court when a previously issued writ has been lost and not executed. Applicable to unlimited civil actions, this form allows a judgment creditor or the creditor’s attorney to declare under penalty of perjury that the original writ’s whereabouts are unknown despite diligent search and inquiry. The declarant must identify the date the writ was issued and the county for which it was issued, and request that the court issue a replacement writ for the same county.
