Form 179Juv - PROBATION BEFORE ADJUDICATION OF DELINQUENCY. This form is used by the Family Court of the State of Delaware to formalize a special type of court-ordered probation for eligible juvenile offenders. Rather than immediately declaring a youth delinquent after a plea of admission or nolo contendere (no contest), the Court may—with the consent of the youth and the State—place the individual on probation under 10 Del. C. § 1009A. This allows the case to be deferred and provides the juvenile with an opportunity to avoid a formal adjudication of delinquency if they comply with the terms of the probation. The form outlines the charges, plea entered, and conditions of the probation, such as school attendance, curfews, community service, substance abuse treatment, behavioral evaluations, counseling, and restitution payments. It also warns the youth that failure to comply with these terms can result in a revocation of probation and formal adjudication, including sentencing as though probation had never been granted.
