Description

SCADR 102 - NOTICE OF ADR. This form notifies parties that their civil case in South Carolina is subject to the state Alternative Dispute Resolution (ADR) Rules and must go to mediation or arbitration (binding or non-binding) within 300 days of filing. Parties may mutually choose the ADR process and neutral; if they cannot agree, the court defaults to mediation and names a mediator (with an alternate if there’s a conflict). The Clerk of Court issues the notice and instructs counsel/self-represented parties to coordinate scheduling and fees with the appointed mediator. A Rule to Show Cause may issue if a Proof of ADR or Exemption is not filed within 300 days of filing or 90 days from the date of this notice. Parties must contact the court-appointed mediator directly to schedule and arrange payment. Failure to timely file Proof of ADR or Exemption can result in sanctions via a Rule to Show Cause. www.FormsWorkflow.com
