Description

G24 - ORDER GRANTING MOTION FOR RELIEF FROM STAY AND CODEBTOR STAY. This form is used in the United States Bankruptcy Court for the Northern District of Illinois when a creditor (the “Movant”) requests permission to proceed with collection or foreclosure actions despite the protections of the automatic stay in a bankruptcy case. When a debtor files for bankruptcy, the automatic stay generally halts creditors from pursuing collection efforts against the debtor or property of the bankruptcy estate, and in Chapter 13 cases, it also protects codebtors. This order documents the court’s decision to grant the creditor relief from those stays, allowing them to pursue their non-bankruptcy remedies, such as foreclosure, repossession, or collection against collateral or codebtors. The form further specifies that the stay under Rule 4001(a)(4), which would normally delay enforcement of such an order, does not apply, meaning the creditor may proceed without delay. Once signed by the bankruptcy judge, this order becomes legally binding and authorizes the creditor to continue its collection efforts outside of the bankruptcy proceeding. www.FormsWorkflow.com
