Description

FC-31 - COMPLAINT FOR AN ORDER OF PROTECTION AND MOTION FOR TEMPORARY EX PARTE ORDER OF PROTECTION WHEN EITHER PARTY IS A JUVENILE. This is a confidential filing used in the Rhode Island Family Court when one or both parties are minors. The form allows a plaintiff to request a civil protective order under R.I. Gen. Laws § 8-10-3(g) and Rule 65 of the Rules of Procedure for Domestic Relations to prevent further abuse, harassment, bullying, or threats. The plaintiff provides identifying details for both parties, including date of birth and county jurisdiction, and specifies whether they are filing individually, as a parent or guardian, or under power of attorney. The complaint lists both parties’ addresses, affirms that the defendant is not on active military duty under the Servicemembers Civil Relief Act (50 U.S.C.A. § 3931), and requests an ex parte (emergency) order if there is a risk of immediate harm. The form allows the plaintiff to check applicable grounds for the protective order, such as physical harm, threats, intimidation, stalking, bullying, or cyberstalking, and provides space to describe the dates and details of each incident. It also includes a certification that no other protective order has been sought based on the same facts. The plaintiff may request specific court relief, such as restraining the defendant from contact or harassment, and an ex parte hearing is scheduled within 21 days to determine whether to continue the temporary order. The document concludes with a Verification of Complaint, which must be signed under oath before a notary public, confirming that all statements are true to the best of the filer’s knowledge. www.FormsWorkflow.com
