SC-02 - NOTICE OF APPEAL; NOTICE OF FILING OF APPEAL SMALL CLAIMS (Code of Civil Procedure § 116.710). This form used in the Superior Court of California, County of Imperial, is filed when a party wishes to appeal a judgment or the denial of a motion to vacate a judgment from a small claims case. This form allows the appellant (either the plaintiff or defendant) to formally notify the court and opposing parties of their intent to have the case reviewed by the superior court. If the appellant is an insurer of a defendant and the judgment exceeds $2,500, the insurer may also appeal on the defendant's behalf if the policy covers the judgment. Once the notice is filed, the small claims division no longer handles the matter, and the superior court assumes jurisdiction. The superior court will later notify the parties of the date to appear for the appeal hearing.
