COC-CV-08C - ORDER AND NOTICE OF GARNISHMENT OF PROPERTY OTHER THAN PERSONAL EARNINGS AND ANSWER OF GARNISHEE. This form issued by the Franklin County Common Pleas Court is used in civil judgment enforcement proceedings to recover money owed to a judgment creditor by a judgment debtor. This form is initiated when the creditor believes that a third party (the garnishee)—such as a bank or another entity—may possess money, property, or credits (excluding wages) belonging to the debtor. The creditor files an affidavit affirming this belief, and the court issues an order requiring the garnishee to respond using the attached Answer of Garnishee. The garnishee must disclose whether they hold property exceeding $625 belonging to the debtor, describe the nature of that property, and remit any appropriate amounts to the court. If the garnishee holds property that cannot be physically delivered, they are instructed to retain it and await further court orders.
