NOTICE TO THE JUDGMENT DEBTOR. This form issued by the Dayton Municipal Court Civil Division under Ohio Revised Code 2716.13(C) is used to inform a judgment debtor that an order has been issued to garnish non-wage money, property, or credits in the possession of a third party (garnishee) to satisfy a court judgment. The form advises the debtor that they are legally prohibited from removing or attempting to remove these funds or assets until authorized by the court and warns of penalties for noncompliance. It also explains that certain types of income—such as Social Security, unemployment, veterans' benefits, and others—are protected by law from garnishment. If the debtor believes the garnishment is improper or that the funds are exempt, they have the right to request a hearing by submitting the enclosed Request for Hearing form within five business days. The hearing will be limited strictly to determining whether the garnished assets are subject to collection, and not to challenge the original judgment.
