MISC012MS - ORDER STAYING WAGE GARNISHMENTS AND DIRECTING TURNOVER OF PROPERTY TO CHAPTER 13 TRUSTEE COMBINED WITH NOTICE OF THE ENTRY THEREOF. This is an order issued by the U.S. Bankruptcy Court for the Western District of Tennessee following the filing of a Chapter 13 bankruptcy petition. The order notifies creditors, employers, and court clerks that all wage garnishments against the debtor are automatically stayed under 11 U.S.C. § 362(a) and that any wages or funds being withheld must be turned over to the Chapter 13 Trustee. Upon filing a Chapter 13 petition, the debtor’s wages and property—both existing and future—become part of the bankruptcy estate under 11 U.S.C. § 1306(a).
