REQUEST FOR CIVIL ACTION HEARING. This form is used in the North Carolina District Court to schedule a hearing in a pending civil case. This form must be completed by one of the parties or their attorney and includes details such as the issues to be heard, the number of witnesses expected, the estimated duration of the hearing, and the nature and date of the last court order entered in the case. In custody cases, participation in the Custody Mediation Program is required before a hearing can be scheduled, and in family financial cases such as equitable distribution or alimony, participation in Family Financial Mediation is also mandatory. The party requesting the hearing must confirm that they have coordinated with the opposing party to identify mutually available dates within the next 90 days and affirm that the case is ready for hearing. Once the form is submitted, the court assigns a judge, date, and location for the hearing. It is the requesting party’s responsibility to properly notify the opposing party of the hearing date, time, and location in accordance with legal procedures.
