ACT 91 NOTICE. This is a formal legal document required by Pennsylvania law to be sent to homeowners who are facing foreclosure. Its primary purpose is to inform the homeowner of their rights and to offer them an opportunity to avoid losing their home. Specifically, it notifies the homeowner that they may be eligible for financial assistance through the Homeowner’s Emergency Mortgage Assistance Program (HEMAP), a state-funded program administered by the Pennsylvania Housing Finance Agency (PHFA). In order to apply for HEMAP, the homeowner must schedule and attend a free, face-to-face meeting with a HEMAP-approved consumer credit counseling agency within 33 days of the date on the notice. This meeting is essential to initiate the application process and may temporarily stop foreclosure proceedings. The notice also explains additional ways the homeowner may be able to save their home, including negotiating with the lender for a loan modification or repayment plan, refinancing, or curing the mortgage default by paying all past-due amounts. Importantly, even if the homeowner has filed for bankruptcy, they may still apply for HEMAP, although the notice itself is not considered an attempt to collect a debt. The Act 91 Notice also includes a summary of the homeowner’s mortgage account, instructions for curing the default, and information on whether the mortgage is assumable.
