Description
PR24017 - ORDER – PRIMA FACIE DETERMINATION (WIC 5977). This form is used by the Superior Court of California, County of Yuba, in CARE Act proceedings to determine whether a petition filed under the Community Assistance, Recovery, and Empowerment (CARE) Act presents sufficient initial facts to move forward. Upon receiving and reviewing the petition (Form CARE-100), the court makes preliminary findings regarding whether the respondent may qualify as a person described under Welfare and Institutions Code section 5972. If the court finds a prima facie case, it may issue orders for further steps, such as directing Sutter Yuba Behavioral Health to prepare a CARE Act report, appointing the Yuba County Public Defender’s Office to represent the respondent, and authorizing notifications for initial court appearances. If the court finds the petition insufficient, it may deny the petition and dismiss the case without prejudice.
