Description

IW -1791T - PERMANENCY HEARING ORDER WITH TERMINATION OF PARENTAL RIGHTS NOTICE INDIAN CHILD WELFARE ACT. This form documents the findings and decisions made at a permanency hearing, which evaluates the child’s current placement and progress toward a long-term, stable living arrangement—such as reunification with the parents, adoption, guardianship, or placement with a fit and willing relative. The court reviews the agency’s permanency plan, determines if the goals are appropriate and achievable, assesses the compliance of all parties involved, and evaluates whether reasonable and active efforts have been made to meet the child’s and parents’ needs. This order includes a Termination of Parental Rights (TPR) Notice, which informs parents of the potential grounds on which their rights may be involuntarily terminated. These grounds range from abandonment and continuing need for protection or services, to failure to assume parental responsibility or prior involuntary TPR involving another child. The notice is a legal requirement to ensure parents are made fully aware of what may lead to termination and what conditions they must meet to avoid it. The order ensures compliance with ICWA requirements, including placement preferences for Native American children and confirmation that active efforts were made to prevent the breakup of the Indian family. It also assesses whether sibling relationships are being preserved and whether the child is being provided with opportunities appropriate to their age and development. If the child is transitioning to adulthood, the court evaluates progress and planning toward independent living. §§ 48.38 and 938.38, Wisconsin Statutes. www.FormsWorkflow.com
