AFFIRMATION OF SERVICE OF INITIATING PAPERS. This form is used in the Supreme Court of the State of New York to officially document the service of legal documents that begin a court case. It is required when serving papers such as a Summons and Complaint, Summons with Notice, Notice of Petition and Verified Petition, Order to Show Cause and Verified Petition, or a Subpoena. The individual who served the papers must be at least 18 years old and not a party to the case. This person must provide detailed information under oath, including the date, time, and exact location where the papers were served, as well as the method of service used—whether personal delivery, substituted service, or service on a business entity. In cases involving substituted service, it also documents the mailing of the legal papers to the last known address of the defendant. Additionally, the server must confirm whether the defendant is believed to be in military service.
