Form MC 200s - INFORMATION FELONY. The State of Michigan Felony Information, Complaint, Summons, and Bindover/Transfer forms are official court documents used throughout the criminal prosecution process when a person is charged with a felony offense in Michigan. These forms serve several legal functions. The Information section is used by the prosecuting attorney to formally notify the court of the specific felony charge(s) the defendant is facing, including the statute(s) violated, the alleged conduct, and the possible penalties. The Complaint serves as the sworn statement by the complaining witness, often the arresting officer or investigator, describing the alleged criminal act and requesting that legal action be initiated against the defendant. When a felony charge is being initiated, a Summons may be issued to compel the defendant’s appearance at an arraignment. This document is issued by a judge upon a finding of probable cause and informs the defendant of the date, time, and location of the hearing. If the case proceeds through a preliminary examination and the judge determines that probable cause exists to support the charge(s), a Bindover/Transfer form is completed. This document certifies that the defendant is being transferred from the district court to the circuit court for further proceedings, such as arraignment on the information, pretrial motions, and eventual trial. In some cases, defendants may waive their right to a preliminary examination, which is also documented here. For juvenile defendants charged with certain serious offenses, a similar process exists for bindover to the circuit court’s criminal division. These forms include essential case identifiers, defendant information, law enforcement reports, witness lists, and certification of procedural steps, ensuring the legal process is documented and compliant with Michigan law.
