Description

JC-1638 - ORDER CONCERNING TERMINATION OF PARENTAL RIGHTS (VOLUNTARY). This form is used in the State of Wisconsin Circuit Court to document the voluntary termination of parental rights. It is completed and entered after a court hearing, during which the court determines that a parent has freely, voluntarily, and knowingly consented to giving up their parental rights. The form includes findings of fact confirming proper notice was given, verifying that the Indian Child Welfare Act does not apply (unless otherwise stated), and affirming that terminating parental rights is in the best interest of the child. It assesses various factors including the child’s likelihood of adoption, age and health, existing familial relationships, and the stability of the child’s current and future placements. The court also confirms whether reasonable efforts were made by the responsible agency to achieve the child’s permanency goals. Upon these findings, the court enters an order terminating parental rights and may transfer guardianship and custody of the child to another party or agency. The form also contains statutory notice provisions informing the birth parents of their rights and obligations concerning medical information and identifying information disclosure under Wisconsin law. §§ 48.41, 48.426, 48.427, and 48.43, Wisconsin Statutes. www.FormsWorkflow.com
