IW-1791 - PERMANENCY HEARING ORDER – INDIAN CHILD WELFARE ACT. This form is used by the Circuit Court in the State of Wisconsin to document the findings and legal decisions made during a permanency hearing involving a child or juvenile who is subject to the protections of the ICWA. This hearing reviews the child’s current placement and progress toward achieving a permanent living arrangement, such as reunification with their family, adoption, guardianship, or placement with a relative. The court evaluates whether the permanency goals outlined in the child’s case plan are still appropriate and assesses the compliance of all involved parties—including parents, guardians, service providers, and the child—with the permanency plan. It also considers whether reasonable and active efforts have been made to support family reunification, especially in accordance with ICWA requirements, which are designed to protect the integrity of Native American families. The order includes determinations about placement safety, service provision, sibling visitation, and the child’s transition to independent living if applicable.
