DECLARATION OF DOMICILE. This form is used by individuals to officially declare their permanent residence, or domicile, in a particular state—most commonly Florida. This form is filed with the Clerk of the Circuit Court (or County Comptroller) in the county where the person resides, in accordance with Section 222.17 of the Florida Statutes. For individuals declaring Florida as their domicile, the form serves as a sworn statement that they reside at a specific address in Florida and intend to make that location their permanent and principal home. Even if they maintain other residences in different states, they assert that their Florida address is their primary home and that they are bona fide Florida residents. Alternatively, the form may be used by individuals who reside in Florida temporarily but wish to declare that their domicile remains in another state. In this case, they state their permanent home is outside Florida, despite possibly having a place of abode within the state. This form is commonly used to establish or reaffirm residency for purposes such as homestead exemption, tax status, voting registration, or other legal matters.
