536 - LANDLORD PETITION FOR DETERMINATION PURSUANT TO RULES AND REGULATIONS SECTIONS 1.21 AND/OR 6.14 AND/OR ORDINANCE SECTION 37.3(d) [Costa-Hawkins Rental Housing Act]. This form is used by landlords in San Francisco to request a ruling from the Residential Rent Stabilization and Arbitration Board on whether a rental unit is exempt from rent control limitations under San Francisco Rent Ordinance Section 37.3. The petition allows landlords to seek an unlimited rent increase based on one or more of the following claims: that the tenant no longer occupies the unit as their principal place of residence (Rules & Regulations Section 1.21), that all original occupants have vacated and proper notice was given to remaining subtenants (Rules & Regulations Section 6.14), or that no original occupants remain, and the current subtenant moved in after January 1, 1996 (Costa-Hawkins Rental Housing Act, Ordinance Section 37.3(d)). The petition requires landlords to provide evidence supporting their claim, including documentation such as utility bills, voter registration, or vehicle registration. If approved, rent increases under Section 1.21 are retroactive, while increases under Sections 6.14 and 37.3(d) take effect after the required 30- or 90-day notice period.
