This form is used by a seller in North Carolina to notify the Department of the Secretary of State that their business qualifies for an exemption under the Business Opportunity Sales Act by definition. It is completed when the business opportunity being offered involves the sale of a marketing program in conjunction with a federally registered trademark or service mark, or when the purchaser pays less than two hundred dollars. The form requires the seller to provide their name, business type (individual, partnership, corporation, or LLC), and principal business address, as well as attach a copy of the relevant federal trademark or service mark registration.
