APPLICATION TO PAY FILING FEE IN INSTALLMENTS. This is a form used in the United States Bankruptcy Court for the Western District of Virginia by debtors who are financially unable to pay the full bankruptcy filing fee at the time of filing their petition. In accordance with Federal Rule of Bankruptcy Procedure 1006 and the corresponding Local Bankruptcy Rule 1006-1, the debtor requests court approval to divide the total fee into smaller, manageable payments made over time—typically in four installments over a period of up to 120 days. The form requires the debtor to affirm that they are unable to pay the fee all at once and agree not to transfer any additional funds or property to attorneys or others for bankruptcy-related services until the full filing fee is paid. The application includes a proposed payment schedule based on the specific bankruptcy chapter filed (e.g., Chapter 7, 11, 12, or 13). It also notifies the debtor that failure to make timely payments can result in dismissal of the case, non-discharge of debts, and continued responsibility for any unpaid filing fees.
