REFUNDING BOND AND RELEASE. This form is used in New Jersey probate matters when a person dies without a will or with a will, and the estate is ready to be distributed to beneficiaries. This legal document must be completed and signed by each beneficiary, including the executor or administrator if they are also receiving a portion of the estate. It serves two primary purposes: (1) it confirms that the beneficiary has received their share of the estate, and (2) it binds the beneficiary to return funds if it is later determined that additional estate debts or obligations must be paid. The signed form must be notarized and filed with the Surrogate’s Court, along with a filing fee. If a surety bond was required during the administration of the estate, this form—along with a Surrogate’s Certificate of Filing—may be needed by the surety company to release the bond.
