Description

721.5 - NOTICE OF HEARING ON MOTION TO EXTEND/IMPOSE STAY PER § 362(C); DEBTOR’S MOTION TO IMPOSE STAY PER § 362(N). This form is used in the United States Bankruptcy Court for the District of Oregon to inform interested parties that a debtor or other movant has filed a motion under 11 U.S.C. § 362(c) or § 362(n) to either extend or impose the automatic stay in a bankruptcy case. The automatic stay is a legal injunction that halts collection activities, foreclosures, and lawsuits against the debtor once a bankruptcy petition is filed. However, in certain situations—such as repeat filings—the stay may not automatically go into effect, or it may expire after 30 days unless extended by court order. The notice also includes the name and address of the movant or their attorney and informs all parties of their right to attend the hearing, during which evidence and witness testimony may be presented. It outlines the procedures and etiquette required for participating in the telephone hearing, including muting the line when not speaking and identifying oneself before speaking. The filer must certify that the notice and the motion were served on all required parties, including the debtor, creditors, and attorneys. www.FormsWorkflow.com
