Description
TC0104 - PROSECUTION CERTIFICATE OF DISCOVERY COMPLIANCE Mass. R. Crim. P. 14.2(e). This form is used in Massachusetts criminal proceedings to confirm that the prosecution has fulfilled its obligations under Rules 14 through 14.4 of the Massachusetts Rules of Criminal Procedure, or as directed by a court order. This form must be completed and filed with the court once the prosecution has disclosed all materials required by law, including police reports, recordings, photographs, tangible evidence, witness statements, expert opinions, and grand jury materials. It also includes information about law enforcement and civilian witnesses, identification procedures, and any statements made by the defendant or co-defendants. The prosecution must disclose any information favorable to the defense, regardless of its credibility, reliability, or admissibility. By signing this form, the prosecutor certifies that a reasonable effort has been made to comply with all discovery obligations. The form further acknowledges the continuing duty to disclose any new information that arises after filing, with a requirement to submit a supplemental certificate if additional discovery is later provided. www.FormsWorkflow.com
