UJS-120C - ORDER FOR PROTECTION. This form is used by the Circuit Court in the State of South Dakota to issue an Ex Parte Temporary Order for Protection in cases involving vulnerable adult abuse. It allows a vulnerable adult—or someone acting on their behalf, such as a substitute petitioner—to request immediate legal protection from an individual (the respondent) who is alleged to have committed acts of abuse. This may include physical, emotional, or psychological abuse, neglect, or financial exploitation. The order restrains the respondent from contacting the petitioner either directly or indirectly, and may include additional restrictions such as prohibiting the respondent from being near the petitioner’s home, workplace, or other specified locations. If the court finds that the respondent has exercised undue control over the petitioner’s finances or property, the order can also revoke that authority and return control to the petitioner or a legal representative. This form is intended to provide swift legal relief in urgent situations where the vulnerable adult is in present danger, and it remains in effect until a hearing can be held or a permanent order is issued. Violation of the order is a criminal offense and may result in arrest, prosecution, and penalties under both state and federal law, including firearms restrictions under U.S. Code.
