4004-1 - CERTIFICATION AND REQUEST FOR ISSUANCE OF DISCHARGE. This form is used in the United States Bankruptcy Court for the Northern District of Oklahoma by debtors who have completed the requirements of a Chapter 13 bankruptcy case and are seeking a formal discharge of their debts. This form certifies, under penalty of perjury, that the debtor has fulfilled all obligations under their confirmed Chapter 13 plan. It confirms either that the trustee has acknowledged full or early plan completion or that the debtor has filed a motion for discharge under special circumstances. The debtor must also indicate whether they completed the required post-filing personal financial management course or are exempt due to disability, incapacity, or military service. The form requires the debtor to confirm whether they were obligated to pay any domestic support obligations and, if so, that all such obligations have been satisfied. It also addresses whether the debtor claimed a homestead exemption exceeding a statutory limit and affirms that they are not subject to any disqualifying legal proceedings such as certain felonies or debts related to fraud. By signing this form, the debtor declares the information is true and understands that the court may revoke a discharge obtained through fraud.
