Description

JP23 - WRIT OF EXECUTION. This form is used by the Pima County Consolidated Justice Court in Arizona is a legal tool that allows a judgment-creditor (the person owed money by court order) to collect on a court judgment when the judgment-debtor (the person who owes the money) fails to voluntarily pay. Once a judgment is entered, the creditor can request that the court issue a Writ of Execution, which directs a constable or sheriff to seize the debtor’s non-exempt personal property or cash and sell it to satisfy the debt. This form must be served within 60 days and returned to the court. There are two types of writs: a General Execution, which applies to any non-exempt property, and a Special Execution, which targets specific property awarded in the judgment. The form also outlines the process for filing, serving, and reporting the results of the writ, including partial or full satisfaction of the judgment. It informs debtors of exemptions—items and property that cannot be taken to satisfy a debt, such as basic household furnishings, certain tools, a modest vehicle, and specific insurance or benefit proceeds—as defined by Arizona law. The form includes penalties for obstructing the execution process and provides space for cost reporting and certification of service. www.FormsWorkflow.com
