1365 - NOTICE OF MOTION AND CHAPTER 12 OR CHAPTER 13 DEBTOR’S MOTION FOR ALLOWANCE OF AND FUTURE PAYMENT ON UNTIMELY FILED CLAIMS. This form is used in the United States Bankruptcy Court for the District of Oregon by debtors in Chapter 12 or Chapter 13 bankruptcy cases. This motion allows the debtor to request the court's permission to treat certain creditor claims—filed late by the debtor on behalf of the creditor—as if they were submitted on time. The form notifies affected parties that if no objection is filed within 14 days, the court may grant the motion without further hearing. The debtor must identify each creditor for whom a late claim is being submitted, the status of each claim (such as secured or unsecured), and the amounts involved. The debtor must also explain why the claims were filed late, usually citing “excusable neglect,” and how allowing these claims would benefit the debtor—such as by ensuring accurate debt repayment or avoiding unnecessary complications in the case.
