TC0085 - RESIDENTIAL SUMMARY PROCESS (EVICTION) NOTICE OF APPEAL OF JUDGMENT. This form is used in Massachusetts and allows either the landlord (plaintiff) or the tenant (defendant) to formally appeal a court’s decision made in an eviction proceeding. The party appealing must submit the notice within 10 days of the date the judgment was entered. The form requires the filer to identify whether they are the landlord or tenant, provide the reason for the appeal, and note any legal issues being challenged. If the defendant (tenant) is still living at the rental property, the form includes an option to request that the court determine whether a bond (a required payment to continue the appeal) must be paid, and if not, to determine the fair rental value of the property during the appeal period. Tenants who are indigent can request a waiver of the bond requirement and may be asked to complete an Affidavit of Indigency. The form includes a certificate of service section, which confirms that the appealing party has sent a copy of the notice to the opposing party or their attorney.
