Description

AFFIDAVIT FOR COLLECTION OF A SMALL ESTATE (INTESTATE). This form is used in the Probate Division of the Missouri Circuit Court (City of St. Louis) when a deceased person leaves no will and the total estate value is $40,000 or less. The affiant—typically an heir—swears that 30 days have passed since death, no probate proceedings are pending, and all debts and taxes have been or will be paid. The affidavit lists the decedent’s domicile, date of death, assets (Exhibit A), and heirs entitled to inherit (Exhibit B) under Missouri’s laws of descent and distribution. Supporting materials include a death certificate, asset valuations, proof of debts, and, if needed, a corporate surety bond. If real property is involved, a legal description and proof of value (from the assessor or an appraisal) must be included.
