CC-DR-095 - COUNTER-CLAIM FOR CUSTODY OR CHILD SUPPORT (Md. Code, Family Law Art., §§ 1-201 and 5-203, Md. Rule 2-331). This form is used in the Maryland Circuit Court when a person who has been served with a complaint or petition (often related to custody or support) wants to respond with their own legal claims regarding the same child(ren). This form allows the respondent—now acting as a counter-plaintiff—to formally request physical custody, legal custody, visitation, and/or child support in response to what the original petitioner (now the counter-defendant) is seeking. The filer must identify their relationship to the minor child(ren), confirm the child(ren)’s current residence, and provide details about the child(ren)’s living arrangements over the past five years. The form requires disclosure of any other legal proceedings involving the child(ren), including custody, support, or protective orders, and any individuals—other than the parties—who may claim custody or visitation rights. The filer must explain why the proposed custody or visitation arrangement is in the best interest of the child(ren) and indicate whether the parties have agreed on a parenting plan.
