CC-DR-005 - COMPLAINT FOR VISITATION (CHILD ACCESS) (Md. Code, Family Law Art., §§ 1-201, 9-102). This form is used in the Maryland Circuit Court by individuals who are seeking court-ordered visitation rights with a minor child or children but do not currently have such an order in place. The form allows a petitioner—whether a parent, relative, or other caregiver—to formally request visitation, without seeking custody. The person filing must identify their relationship to the child(ren), list where the child(ren) currently reside and with whom, and provide background on any related court cases involving the child(ren), such as custody, child support, guardianship, or adoption. If the filer is not a biological or adoptive parent, they may need to show they qualify as a de facto parent or allege that the biological/adoptive parent is unfit or that exceptional circumstances exist—both of which are legal standards requiring strong evidence. The filer must explain why visitation is in the child’s best interest and propose a reasonable visitation schedule, including specific days, holidays, or locations. The form must be signed under penalty of perjury and must be served on all other parties.
