IW -1711 - ORDER FOR TEMPORARY PHYSICAL CUSTODY (SECURE/NON-SECURE) - INDIAN CHILD WELFARE ACT. This form is used in the Wisconsin Circuit Court to order temporary physical custody of an Indian child or juvenile under the Indian Child Welfare Act (ICWA). It is issued after a hearing to determine whether there is probable cause to remove the child from their home due to concerns such as risk of harm to the child or others, neglect or inability of the parent or guardian to provide adequate care, or risk of the child running away. The court evaluates whether emergency removal and placement outside the home is necessary to prevent imminent physical damage or harm to the child. The form includes findings related to efforts made to prevent removal, maintain sibling groups in placement, and the appropriateness of the placement, including whether the placement is certified as a Qualified Residential Treatment Program. The court considers recommendations from the department or agency responsible for services and may order the child placed out-of-home with continued care responsibility.
